    Unsurprisingly, poor dietary choices (and their offspring, obesity) raise more questions than merely those related to image and health (e.g., “will I ever fit into these jeans again? or “how can I lower my blood pressure?”). Today, several NY Times correspondents debate the contention that obese people “cost” a lot more than people of normal weight, and therefore need legislation to protect them against employment discrimination:

    How do we feel about this? As a lawyer, my instinct is “no way,” primarily because I don’t think of fat people as a “protected class” deserving of the constitutional prohibitions of discrimination on the basis of race, gender, or religion. On the other hand, assigning “fault” systematically to every overweight person, by not protecting them from such discrimination, seems wrong to me.

    I’m curious how this debate would play out in our community. How do we, as the healthiest people in our community, view this question?

      Mike, wow, there is so much material to read there! I’m going to have to sit down with it and think about it for a while. Without having read through the materials, though, I will point out that the District of Columbia Human Rights Act has protection from discrimination based on personal appearance. In addition, protections under the Americans with Disabilities Act and Rehabilitation Act could apply to certain people who need accommodations in the workplace for some disabilities that are by-products of obesity/overweight (although obesity itself is not a qualifying disability). Can’t wait to read more about this! Thanks for bringing it to our attention.
